Why make mods, why not use one of the main indie engines?

Over the years I've seen a lot of total conversions attempted to be made for fallout 1 and 2 and some have been completed and some have failed. Why can't all of us make a fallout template inside of a free engine like unity, and then everyone make their own mod there? All of us could work together to make a "Fallout 1 and 2 Framework" where the whole game is and core fundamentals are all there and others can build off that, but all for free?

I know there are copyright issues, but isn't that only true when the product is to be sold?
 
There have been attempts, the FOnline engine, for example. I think it's mostly convenience and nostalgia. People have been using the modding tools for Fallout 2 for a long time, and it might just be easier for them to just continue doing that, especially for mods that can use many of the old assets.
Personally, I think an open source SPECIAL engine would be really cool. Great ideas have been thrown around by the Fallout community and sometimes even put together and refined into quasi-sourcebooks for PnP sessions.
