Bethesda appeals to the court, again

WorstUsernameEver

But best title ever!
I actually missed this yesterday when it was tipped to us, so apologies for that, but it appears that Bethesda has appealed the court ruling that denied their second request for preliminary injunction. Here's from the court filing:
IN THE UNITED STATES DISTRICT COURT
FOR THE DISTRICT OF MARYLAND
Southern Division (Greenbelt)
BETHESDA SOFTWORKS LLC,
Plaintiff/Counter-Defendant,
v.
INTERPLAY ENTERTAINMENT CORP.,
Defendant/Counter-Plaintiff.
Civil No. 09 CV 2357 (DKC)
NOTICE OF APPEAL
Notice is hereby given that Bethesda Softworks, LLC, plaintiff/counter-defendant in the
above-captioned case, hereby appeals to the United States Court of Appeals for the Fourth
Circuit from the order denying its motion for preliminary injunction stated in open court on the
record by the Court on August 4, 2011.
Date: August 9, 2011 Respectfully submitted,
FRIED, FRANK, HARRIS, SHRIVER &
JACOBSON LLP
This is the second time Bethesda appeals, although the first time they dropped it.

Thanks, Ausir and a Mysterious Stranger.

Oh god, this is becoming quite embarrassing. In the meantime they also tried to put Notch (Minecraft founder) in jail because he named his new game "Scrolls". If you're a bored lawyer, join Bethesda, they will give you something to do.

And the dumbass keeps saying "Bethesda are nice people" or some nonsense.

Bo at him Bethesda, bring your scrolls home.

Perhaps they still hope the judge played some Oblivion/FO3 in the meantime and has finally seen the awsomeness of Beth.

I'm hoping this is true, but the judge played the first 2 fallouts and elder scrolls first.

That was Zenimax Media, Bethesda's parent company, not Bethesda.

Still, It's rather silly.

Looks like bethesda is just trying to rack up legal costs for Interplay until they can't afford to fight back anymore.

Well, this isn't really different to the events of the real world, a would-be robber was on a roof a woman's house, when he was above the kitchen, the roof collapsed and the robber landed on a knife the woman had left facing upwards, now the robber is suing the woman.

It's such a finnicky issue, but the ball is TECHNICALLY in Bethesda's court. Interplay sold the Fallout Intellectual property to them, they have very little ground to stand on.

I'm pretty sure that story was just from a movie.

It's not, but the way ViewedCloth put it isn't EXACTLY accurate. http://overlawyered.com/2006/09/the-burglar-and-the-skylight-another-debunking-that-isnt/
