I think Interplay's lawyers have found some big holes in the Asset agreements. Interplay might not deserve to win but their lawyers do.
 
I think the best that could happen is to actually give the lawyers the rights over Fallout and let them do a new game. If they win. I mean imagine they show as much skill here like in the court
 
That'd be pretty awesome. We already have a lawyer here so I guess the game wouldn't turn out to be that bad...

But to be honest, I just felt like Bethesda loosing. You know, I don't really care that much for Interplay because of their CEO, but I surely care for Bethesda... in a bad way. A better alternative would be Obsidian (so far, so good), but I guess it's not up to me to decide who wins (and who's next).
 
The MMO market is over saturated, anyway. They should take their lawyers' failure as a blessing to not invest into a long, costly development cycle that might have a catastrophic flop.
Stick with what you know, in this case. If it was something revolutionary, then it might be worth fighting for. It's not.

The Judge asks Bethesda's lawyer:

Are you making a fallout MMO?

The Bethesda lawyer says No.. then
backtracks and says "i do not know" and "i cant answer that"

A competent lawyer should know that answer and if it was truly negative, he would have denied categorically/emphatically any Bethesda involvement in secretly developing a Fallout MMO.

He did not- Leaving open to speculation that Bethesda is secretly developing a Fallout MMO.

The judge has not even processed the fact that Bethesda cannot even make a Fallout MMO without flagrantly violating the agreement with Interplay.

The judge and appeals court allowed Interplay to continue to internally develop Fallout MMO.

Bethesda is not allowed to develop any Fallout MMO whether publicly or secretly unless and until after they win all the rights to Fallout in court pending an appeal.

Making a Fallout MMO game before having the FULL LEGAL RIGHTS to do so leaves a whole contract invalidated. If I give you a license to develop a game in exchange for a payment and then turn around and secretly develop my own version of the game on the assumption that you will not be able to develop it and then be surprised to find out that you are developing it, I basically signed a contract in bad faith and I am liable to having violated it flagrantly and can expect for the contract to be torn up and returned to a prior version if such a version exists.

So, as Bethesda's brass possibly scramble to erase all evidence of a Fallout MMO before they go under oath, have they fathomed what may happen to them if they lose the ownership rights to Fallout and are forced to pay Interplay 12% royalties off of 600 Million USD in sales in addition to double or treble punitive damages and accrued interest?

For those that have an aversion to basic math, that would be 72 million minimum doubled or trebled to up to and possibly over 216 million dollars( counting DLC's etc...) and loss of any further games to make beyond one more Fallout.

Counting the debt incurred in buying Id and marketing all the 75+ million dollar games they have coming out, take out 216 million dollars and Bethesda's owners Zenimax faces a possible instantaneous debt default to their creditors who would then have the right to collect on a once mighty but suddenly crestfallen Zenimax/Bethesda in bankruptcy court barring a last minute bailout at steep costs to Zenimax CEO Robert Altman and company( aka loss of majority control over Zenimax's privately held shares and voting rights)

The staggering amount of money at stake here puts both Interplay and Bethesda at risk and not just Interplay as previously assumed by many if not most within the peripherally clued in gaming community.

yes but that is very unlikely.

Not to mention the "shitstorm" by the Bethesda fans which would blame obviously Iplay for it as "poor" Bethesda was a victim.

Gamers are a strange folk.
 
Our loyalties to these companies are only as strong as the games they make...when Interplay started to make trash, then they were trash in the eyes of many. In the end it's the clever individuals and their ideas, and not companies, that make good games. I don't think many people really care about the final outcome of the Interplay / Bethesda court case, both of them are douches, and with luck a new player will come along build a RPG to sink their shitty boats.

Do what I do - play the golden oldies and don't give a fuck.
