Bethesda's preliminary injuction denied, again

WorstUsernameEver

But best title ever!
You may remember that Bethesda filed for a temporary injunction to stop Interplay from working on Fallout Online again, after their first request was dismissed, claiming as motivation the fact that Interplay didn't have the right to use anything but the Fallout name and that they were actively trying to undermine their work.

Well, The Vault reports that this request has too being denied, meaning that, as of now, Interplay can continue to work on Fallout Online. Here's a summary:
Motion Hearing held on 8/4/2011 [114] and [115] MOTIONS for Preliminary Injunction filed by Bethesda Softworks LLC - Argued - "DENIED" for reasons stated on the record by Chief Judge Deborah K. Chasanow. (Court Reporter: Sharon O'Neill) (td, Deputy Clerk)
Thanks, Ausir.

Apparently, not tender enough. Keep trying to beat on it more.

Kinda reminds me of that trailer for Far Cry 3. The definition of insanity: To repeat something over and over again thinking its going to be different next time.

Smooth, just smooth.

Usually that's the normal human behaviour.

Sad I know, but still...

Good Interplay should be able to make this game. They invented it!!! Go AWAY Bethesda and work on Skyrim or something.

They had no problem with selling the franchise and 'torpedoing' black isles, who were the guys who invented it.

Just when you thought Bethesda had learned their lesson. Makes me wonder if Bethesda's lawsuits are nothing but practical jokes.

It makes me wonder why people even like Bethesda.

Even if you enjoy the games, you can't possibly endorse this sort of legal hackeysack.

Not to mention:

Elder Scrolls vs Notch’s Scrolls?

Alleges Minecraft-maker Notch on Twitter: “Just got a letter from Bethesda’s lawyers. They claim “Scrolls” infringes on their trademark and everyone will confuse it with Skyrim.”

Those people are seriously nuts.

But Interplay's legal hackeysack is OK?

Lol, what? Not so long ago he has a nice discussion with Todd Howard, now they send him a notice of copyright infringement over the word ''scrolls''? I certainly hope it's Bethesda lawyers being utter imbeciles again and not the company's leadership.

Next they'll be suing the Abrahamic faiths over the Dead Sea Scrolls. Sounds like a TES title already. :V

yeah and when you consider how old those are ... just imagine the possibilities of the compensation ! It might be worth billions of billions dollar!. *KA-CHING* !

Though why did they not considered to sue the government for their use of "fallout" in their propaganda cartoons/videos from the 50s trough the 60s and 70s.

The evidence is pretty clear. Every judge can see it clearly.

And just think of the possibilities for all the games stealing the word "The" which could confuse people and make them think of "The Elder Scrolls".

IT IS!

OH SNAP!

Imagine if they put all that creative energy in thinking up lawsuits against people and other companies, and actually used that in game development.

Perhaps the universe would not be able to contain the awesomeness that that would create.

Heh, pipe dream.

I don't actually expect execs and lawyers to be especially good at game design or development.
